These Terms of Service ("Terms") govern your access to and use of the pacepro.io website and the PACE growth platform (the "Service"), operated by PACE Pro, a Third Fourth company ("PACE," "we," "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

PACE is a software platform that helps businesses generate, optimize, publish, and report on marketing content and campaigns. Features, integrations, and availability may change over time as we improve the Service.
Accounts and eligibility
You are responsible for your account, your login credentials, and all activity under your account, and for keeping the information you provide accurate. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

- Do not use the Service for any unlawful, infringing, deceptive, or harmful purpose.
- Do not upload or publish content you do not have the rights to use.
- Do not attempt to disrupt, probe, reverse engineer, or gain unauthorized access to the Service.
- When you connect third-party integrations (such as Google), you agree to comply with those providers' terms and policies.
Your content and data
You retain ownership of the content and data you provide. You grant PACE a limited license to host, process, and use that content and data as needed to operate and provide the Service. You are responsible for ensuring you have the rights to any content you provide and choose to publish.
AI-generated content
PACE uses artificial intelligence to help generate content and recommendations. You are responsible for reviewing and approving content before it is published. PACE does not guarantee any specific outcome, including rankings, traffic, leads, or revenue. Results vary by market, industry, and starting point.
Third-party services
The Service integrates with third-party services, including Google. Your use of those services through PACE is also subject to their respective terms and privacy policies. We are not responsible for third-party services or their availability.
Fees
If you purchase a paid plan, the fees, billing cycle, and terms will be described at the time of purchase. Unless stated otherwise, fees are non-refundable except as required by law.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular result.
Limitation of liability
To the maximum extent permitted by law, PACE and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us in the twelve months before the claim, or 100 US dollars if you have paid nothing.
Indemnification
You agree to indemnify and hold PACE harmless from claims, damages, and expenses arising out of the content you provide or your misuse of the Service.
Termination
We may suspend or terminate access to the Service for any violation of these Terms. You may stop using the Service at any time.
Governing law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. The courts located in Tennessee will have exclusive jurisdiction over any dispute arising from these Terms or the Service.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new effective date, and your continued use of the Service after changes take effect constitutes acceptance.
